Terms of service

Terms of sale, service, warranty and delivery conditions.

 

All sales to businesses (B2B) are subject to the Contracts Act and the purchase is not covered by the Sale of Goods Act.

For sales to private consumers, all points in these Terms of sale, service, warranty and delivery conditions apply,
except for the deviations described in section 14.

1. Conclusion of agreement
It is assumed that the buyer, when ordering, has familiarised themselves with these terms of sale and delivery. Offers from the seller are binding for 2 weeks from the date of the offer.
Interim sales reserved.
The seller and the buyer may require that the offer be signed by both parties.
An order placed in the online shop is considered an offer accepted by the buyer.
If, before completion of the sale relative to the offer date, there are changes to VAT, customs or export duties, or if, as a result of government intervention or legislation here or abroad, unforeseen surcharges and costs arise, the seller has the right to include these in the offer prices.

2. Prices and price guarantee
Prices are stated in printed material and verbally excluding VAT and ex works.
Prices on the website are shown both with and without VAT and ex works.
Typographical errors and price changes are reserved.
Prices are stated without handling fees or other charges.
The seller provides a price guarantee on all standard goods. The price guarantee applies if the buyer, before purchase or within 8 days after purchase, finds the same product in Denmark at a lower price. Price comparisons must be from Denmark, and the buyer must be able to document the price and that it is the same product delivered under the same conditions. If confirmed, the seller will immediately issue a credit note for the price difference.

3. Payment
Payment terms are net cash and ex works. Cash payment upon collection.
Prepayment may be made by bank transfer and by payment with Dankort, credit card or MobilePay.
If the item is to be shipped, payment is charged when the order is dispatched. When paying with a corporate credit card, the buyer pays any card fee imposed by the card issuer.

4. Delivery time and force majeure
Delivery takes place as soon as possible, unless otherwise agreed. The seller strives to dispatch orders
placed before 12:00 the same day. The seller reserves the right to make partial deliveries.
If a delivery time is stated, it applies subject to force majeure, accidents, possible delay of ordered materials and delay in production due to workshop accidents and delays from the seller’s subcontractors. In the event of delay, both buyer and seller may, by written notice to the other party, release themselves from the purchase/sale.

5. Shipping and transfer of risk
All shipments are ex works and therefore at the buyer’s expense and risk. The order is considered delivered when the buyer or the buyer’s carrier takes over the goods from the seller’s warehouse. If a dispatch is postponed due to the buyer’s circumstances, the risk transfers to the buyer from the day the goods should have been dispatched.

If the seller deems that special packaging is required, he will perform this at the
buyer’s expense.

6. Receipt and complaint
The buyer is obliged to receive the goods at the time stated in the order confirmation. The buyer is obliged to inspect the goods immediately upon receipt. Claims regarding defects and deficiencies must be made immediately to the carrier or in writing to the seller within 3 days of delivery. If the buyer fails to complain within this period, they cannot later invoke any defects.
The seller undertakes to repair, replace or otherwise remedy any defects as soon as possible.
Claims regarding damage during transport must be reported immediately to the carrier.
The seller has no liability for loss of operation, loss of profit or other indirect costs as a result of defective delivery.

7. Production and product development rights
Goods developed by the seller must not be copied pursuant to, among other things, the Danish Marketing Practices Act’s rules on this.
All drawings, proposals and offers are the seller’s property and may not be used, copied, published or made available to others without the seller’s written permission.

8. Returns
Returned goods are only accepted after agreement with the seller and only in undamaged condition and in original packaging.
Nothing must be written on the packaging.
A copy of the relevant invoice must be enclosed. Returned goods are sent at the buyer’s risk and expense.
For returned goods, a deduction/handling fee of 15% is deducted from the originally invoiced price to cover goods inspection, warehouse handling, new packaging, etc., but a minimum of 150,- DKK.
Custom-made and specially ordered goods are not taken back.
Goods with a value under 350,- DKK are not accepted for return.
Returned goods must be sent to Vidtskue Vej 12, 7100 Vejle.

9. Retention of title
The seller reserves ownership of the sold goods until the entire purchase price and the costs associated with delivery of the goods have been paid by the buyer. Until full payment has been made, the goods must be kept in the same condition as delivered and they must be insured by the buyer at new-value against fire, theft and water damage.

10. Product warranty
The seller provides a 12-month product warranty for product defects.
If it can be shown that a defect is due to the product’s construction or manufacture, the seller undertakes to
as soon as possible replace, repair or otherwise remedy the defective goods.
Replacements or repairs take place at the seller’s premises. The product warranty does not cover defects attributable to wear and tear, incorrect use, lack of maintenance or defects that could be detected upon receipt.

11. Product liability
The seller does not cover indirect losses caused by the seller’s products. This includes, but is not limited to, loss of operation, loss of profit or other indirect losses.
The seller is only liable for damage to real property or personal property that is not part of what the seller delivered, when this is covered by the seller’s product insurance. The seller is not responsible for damage to products that are manufactured and/or installed by the buyer — even if the seller’s products are included.
To the extent the seller may be held liable for product liability towards third parties, the buyer is obliged to indemnify the seller to the same extent. If a third party brings a claim against one of the parties for compensation under this section, that party must immediately notify the other.
The seller and the buyer are mutually obliged to submit to the jurisdiction of a court that handles compensation claims brought against one of them on the basis of damage alleged to have been caused by the delivery.

12. Privacy policy
SuperSellerS understands and respects the importance of privacy on the internet. We will not disclose information about customers/users to a third party beyond what is necessary to carry out a transaction. SuperSellerS will never sell your name, address, email address, credit card or personal data to any third party under any circumstances.

13. Supplemental guarantee
The seller undertakes, within a reasonable period, to be able to supplement a delivery.
Reservations apply that the product may have changed in design and/or been discontinued by subcontractors.

14. Sales to private consumers.
Special rules apply to sales to private consumers.
If a product is purchased by a private consumer for private use, the following changes apply:
Payment.
Consumers are not charged credit card fees.
Product warranty.
Consumers have a 2-year product warranty.
All other warranty matters are as previously described.
Complaints must be made within a reasonable time after the defect is discovered. Complaints made within 14 days after the defect is discovered are always considered timely.
Right of withdrawal:
Consumers have a 14-day right of withdrawal in accordance with applicable law.
The withdrawal period expires 14 days after the day on which the goods were received.
To exercise the right of withdrawal, the buyer must notify the seller of their decision before the deadline
via the webshop’s return function, e-mail or another unambiguous statement.
In the event of a valid withdrawal, the seller will refund all payments received, including standard delivery costs, no later than 14 days after receipt of the notification of withdrawal.
Larger items typically require a freight carrier, which can amount to several thousand kroner, depending, of course, on the size of the shipment and the distance to the Seller.
Worst case up to perhaps 10.000 DKK.
The buyer is therefore encouraged to check the return costs before initiating a return.
The item must be returned in the same condition and quantity as when received.
The customer is liable for any loss in value caused by handling other than that necessary to determine the nature, characteristics and functioning of the goods, and it is the customer’s responsibility that the shipment reaches the seller in the same condition as it left the seller.

15. Choice of law and venue
All transactions are governed by "The International Sale of Moveable Property Act"
(Consolidation Act no. 722 of 24.10.1986).
The venue for disputes concerning the transaction is the Maritime and Commercial Court in Copenhagen.

You may file a complaint about an item you purchased from us with the Centre for Complaint Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg.
